You Drink And Drive - You Pay

Missouri DWI Laws

Driving while intoxicated (DWI) is a serious offense in Missouri. The consequences of drinking and driving can be devastating — not only for the impaired driver but for innocent victims. Missouri law enforcement agencies, including the Missouri State Highway Patrol, are committed to keeping impaired drivers off the road.

What Is the Legal Limit?

In Missouri, it is illegal to operate a motor vehicle with a blood alcohol content (BAC) of:

• .08% or higher for drivers 21 and older

• .02% or higher for drivers under 21 (zero tolerance)

• .04% or higher for commercial vehicle drivers

You can also be arrested for DWI even if your BAC is below .08% if alcohol or drugs have impaired your ability to drive safely.

Consequences of DWI

First Offense

• Up to 6 months in jail

• Fine up to $500

• 30-day license suspension followed by 60-day restricted driving period

• Points assessed against your driving record

• Possible required installation of an ignition interlock device

Second Offense

• Up to 1 year in jail

• Fine up to $1,000

• 1-year license revocation

• Required ignition interlock device

• Possible vehicle seizure

Third and Subsequent Offenses

• Felony charges

• Up to 4 years in prison

• Fine up to $5,000

The Hidden Costs

Beyond the legal penalties, a DWI conviction carries significant financial and personal costs:

• Attorney fees: $2,000 - $10,000+

• Increased insurance premiums: $4,500+ over 3 years

• Court costs and fines

• Substance abuse treatment programs

• Lost wages from jail time and court appearances

• Towing and impound fees

• Ignition interlock device costs

• Impact on employment and professional licenses

Make the Right Choice

• Designate a sober driver before going out

• Use ride-sharing services or public transportation

• Call a taxi or a friend for a ride

• Stay where you are until you are sober

• Never let a friend drive impaired
